Hello and thank you for the opportunity to comment on this important process. I am Donn Heckelmoser, the CEO of Barton Communities and a resident of Lakewood. I have no problem with the city issuing an RFP and hiring a broker through a competitive process to help sell city owned properties (because the criteria for hiring will presumably be specified in the RFP).
However, I would like to express some concern with section #3 and #4. These sections authorize the administration to complete the sale of the listed parcels without specifying the process by which offers will be assessed. As an interested party and resident, I would suggest removing section #3 and #4 completely OR modifying the ordinance to include the following:
1. How will the broker seek proposals/offers?
2. How long will proposals/offers be accepted for?
3. How will the value of a proposal/offer be compared to another?
4. Will the final use be required to be revealed or considered as part of the offer?
5. Will an offer that involves an option agreement be regarded as a valid offer?
