ORDINANCE 18-2025 - AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, to amend Chapter 1775, Weeds, of the Codified Ordinances of the City of Lakewood for the purpose of establishing regulations for front yard plantings. I strongly oppose the addition of 1775.03 “Front Yard Plantings” as an overreach of local government into private property rights.
While the goal of promoting ecological landscaping is commendable, this ordinance goes too far by imposing rigid restrictions, like specific setbacks, turfgrass buffers, and plant height limits, even on intentional, well-maintained, and beneficial plantings.
Property owners have a constitutional right to the reasonable use and enjoyment of their land. Aesthetic preferences and sight lines can already be addressed under existing ordinances without micromanaging front yards.
This sets a troubling precedent of government OVERREACH and undermines personal freedom. I urge Council to reject this ordinance and instead support voluntary guidelines that promote biodiversity without infringing on individual rights.
